These Terms and Conditions govern the sale of goods by The Mensa Table Company (โweโ, โusโ, โourโ) via our website www.mensatableco.co.uk (โWebsiteโ).
Please read these Terms carefully before placing an order. By placing an order, you agree to be legally bound by them.

2. Definitions
In these Terms:
- โGoodsโ means any bespoke tables, chairs, benches, timber products, accessories or other items manufactured or supplied by us now or in the future.
- โBespoke Goodsโ means Goods made to your specific measurements, finish, timber selection, or design specification.
- โContractโ means the legally binding agreement between you and us for the sale of Goods.
- โConsumerโ means an individual acting for purposes wholly or mainly outside their trade, business, craft or profession.
- โBusiness Customerโ means a customer acting in the course of business.
3. Basis of the Contract
3.1 Product descriptions, images, measurements and specifications on our Website are provided for illustrative purposes only.
3.2 Timber is a natural material. Grain, tone, knots, colour variation, and movement are inherent characteristics and will vary from piece to piece. These variations do not constitute defects.
3.3 Your order constitutes an offer to purchase Goods.
3.4 A Contract is formed only when we issue written order confirmation.
3.5 We reserve the right to refuse any order at our discretion.
4. Bespoke and Made-to-Order Items
4.1 The majority of our Goods are made to order.
4.2 You are responsible for ensuring that:
- All measurements provided are accurate.
- Access routes, doorways and staircases are sufficient for delivery.
- Floor loadings are appropriate for large timber furniture.
4.3 We are not responsible for Goods that do not fit where measurements supplied by you are incorrect.
4.4 Natural movement, minor dimensional tolerances (typically ยฑ5mm), and tonal variation are normal characteristics of solid timber.
5. Price and Payment
5.1 Prices are shown in GBP (ยฃ) and include VAT where applicable.
5.2 Delivery charges are stated separately.
5.3 We reserve the right to amend prices at any time prior to order confirmation.
5.4 Payment terms:
- Full payment at time of order; or
- A deposit (typically 50%) with balance payable prior to dispatch (where agreed).
5.5 We reserve the right to suspend manufacture or delivery if payment is not received.
6. Production Times
6.1 Production times are estimates only.
6.2 Delays may occur due to timber supply, curing times, workshop capacity, or events beyond our control.
6.3 Time for delivery is not of the essence unless expressly agreed in writing.
7. Delivery
7.1 Delivery is made to the address provided at checkout.
7.2 Delivery dates are estimates only.
7.3 Risk passes to you upon delivery.
7.4 If delivery cannot be completed due to access restrictions or absence, additional delivery charges may apply.
7.5 You must inspect Goods on delivery and notify us within:
- 48 hours for visible damage.
- 7 days for other issues.
8. Consumer Cancellation Rights (Distance Selling)
8.1 If you are a Consumer, you may have rights under the Consumer Contracts Regulations 2013.
8.2 However, the right to cancel within 14 days does not apply to Bespoke Goods made to your specifications or clearly personalised.
8.3 For non-bespoke items, you may cancel within 14 days of delivery.
8.4 Returned Goods must be:
- Unused,
- In original condition,
- Properly packaged.
8.5 You are responsible for return costs unless Goods are faulty.
9. Returns and Refunds
9.1 Bespoke Goods are non-refundable unless faulty.
9.2 Refunds (where applicable) will be processed within 14 days of receiving returned Goods.
9.3 We may make deductions for diminished value resulting from handling beyond what is necessary to establish the nature and characteristics of the Goods.
10. Faulty or Damaged Goods
10.1 We warrant that Goods will:
- Be of satisfactory quality;
- Be fit for purpose;
- Match their description.
10.2 If Goods are faulty, you may be entitled to repair, replacement or refund in accordance with the Consumer Rights Act 2015.
10.3 Timber movement, small cracks, checking, resin bleed, colour change and grain variation are natural characteristics and not faults.
11. Care and Maintenance
11.1 Solid timber furniture requires appropriate environmental conditions.
11.2 You must:
- Maintain stable humidity (ideally 40โ60%).
- Avoid placing furniture near radiators or underfloor heating without protection.
- Use appropriate care products.
11.3 We are not liable for damage caused by improper care, environmental extremes or misuse.
12. Limitation of Liability
12.1 Nothing in these Terms excludes liability for:
- Death or personal injury caused by negligence;
- Fraud or fraudulent misrepresentation;
- Any liability that cannot lawfully be excluded.
12.2 Subject to clause 12.1, our total liability shall not exceed the price paid for the Goods.
12.3 We shall not be liable for:
- Indirect or consequential losses;
- Loss of profits (for Business Customers);
- Business interruption.
13. Title
13.1 Ownership of Goods passes to you only when full payment has been received.
13.2 Until title passes, we reserve the right to:
- Repossess Goods;
- Enter premises to recover them (Business Customers only).
14. Intellectual Property
14.1 All designs, drawings, images, product names and content on our Website remain our intellectual property.
14.2 You may not reproduce, copy or use our designs without written permission.
15. Force Majeure
We are not liable for delay or failure to perform due to events beyond our reasonable control, including but not limited to:
- Timber supply shortages
- Transport disruption
- Natural disasters
- Government restrictions
16. Privacy and Data Protection
16.1 We process personal data in accordance with UK GDPR.
16.2 Please refer to our Privacy Policy available on our Website.
17. Business Customers
17.1 If you are purchasing as a Business Customer:
- All implied warranties (to the fullest extent permitted by law) are excluded.
- You are responsible for ensuring suitability of Goods.
17.2 These Terms and Conditions apply only to customers purchasing as Consumers (that is, individuals acting wholly or mainly outside their trade, business, craft or profession).
17.3 If you are purchasing Goods in the course of a business, trade, profession or commercial activity, you shall be deemed to be a Business Customer.
17.4 Where you are a Business Customer:
(a) our Trade & Wholesale Terms and Conditions shall apply to the exclusion of these Consumer Terms; and
(b) in the event of any inconsistency between these Consumer Terms and our Trade & Wholesale Terms, the Trade & Wholesale Terms shall prevail.
17.5 By placing an order in the course of business, you confirm that you have read and accepted our Trade & Wholesale Terms and Conditions.
18. Dispute Resolution
18.1 We aim to resolve complaints amicably.
18.2 If a dispute cannot be resolved, you may refer the matter to alternative dispute resolution where applicable.
19. Governing Law
19.1 These Terms are governed by the laws of England and Wales.
19.2 The courts of England and Wales shall have exclusive jurisdiction.
20. Amendments
20.1 We may update these Terms from time to time.
20.2 The version in force at the time of your order applies to your Contract.
